DISPUTE RESOLUTION

We advise individuals, businesses and organisations on all forms of dispute resolution, from early-stage negotiation through to court proceedings. Our approach is strategic and pragmatic: we assess each dispute on its merits, advise on the most effective route to resolution and pursue the best outcome for our clients, whether that is achieved through negotiation, mediation, arbitration or litigation.

Commercial & Contractual Disputes

We act for claimants and defendants in a wide range of commercial and contractual disputes, including shareholder and partnership disputes, breach of contract claims, supply chain and distribution disputes, joint venture disagreements and professional negligence claims. We advise on strategy from the outset and manage cases through to resolution.

Property & Construction Disputes

We advise on disputes arising from property transactions, development projects, construction contracts, landlord and tenant relationships and boundary issues. Our work includes claims for breach of contract, defective works, dilapidations, forfeiture and possession proceedings.

Probate & Inheritance Disputes

We act for beneficiaries, executors and other parties in disputes over wills, estates and succession. Our work includes claims under the Inheritance (Provision for Family and Dependants) Act 1975, challenges to the validity of wills, disputes between executors and beneficiaries and claims arising from the administration of estates.

Debt Recovery & Insolvency Disputes

We advise creditors and debtors on the recovery and enforcement of debts, including statutory demands, county court claims, charging orders, third-party debt orders and enforcement proceedings. Where debt disputes intersect with insolvency, we work closely with our insolvency and restructuring team.

Mediation & Alternative Dispute Resolution

We are strong advocates of mediation and other forms of alternative dispute resolution where they offer a realistic prospect of achieving a satisfactory outcome. Mediation can be quicker, less costly and less adversarial than court proceedings, and courts increasingly expect parties to have considered it before issuing a claim. We advise on the suitability of ADR, prepare clients for the process and represent them throughout.

Arbitration

We advise and represent clients in domestic and international arbitration proceedings, including disputes governed by institutional rules and ad hoc arbitrations. Arbitration can offer confidentiality, flexibility and finality, and we help clients assess whether it is the right mechanism for their dispute.

Cross-Border Disputes

We have particular experience in disputes involving parties, assets or issues in more than one jurisdiction. We advise on questions of jurisdiction, applicable law, service out of the jurisdiction, the recognition and enforcement of foreign judgments and the practical challenges of managing litigation across borders.
